Federal Court Mandates Release of Abrego Garcia from ICE Custody

A federal judge has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing detainment is without lawful basis.

"Since Abrego Garcia's return from wrongful imprisonment in El Salvador, he has been re-detained, again without legal justification," the judge wrote in her order.

The case stems from a mistaken removal to El Salvador earlier this year, which the government later admitted was an error. After his return to the United States to face alien smuggling charges, he was held in federal detention.

In her order, the judge noted that the government does not have a current deportation order, which effectively blocks them from removing Mr. Abrego Garcia "for now."

Context of the Case

The legal proceedings center on conflicting assertions. While the former administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this allegation.

He has also pleaded not guilty to the smuggling counts, which are part of a ongoing trial in Tennessee.

The court, who was hearing his petition to deportation in a Maryland district court, determined that he must now adhere to the conditions of his bond from jail in Tennessee. This order shifts his supervision to the jurisdiction handling his criminal case.
